Family Law
Experienced New York matrimonial law attorney
Divorces have unfortunately become a part of life. Even as Christian couples, it can prove impossible to put your differences with your spouse aside and divorce may be the only answer. The Law Offices of Maurice J. Verrillo, P.C. can help without judgment on your particular situation.
New divorce laws in New York
In October 2010, revised New York state family laws were enacted. These laws address many domestic issues, but the most significant changes are the following:
- Couples may divorce on a no-fault basis, citing grounds of irretrievable breakdown
- There is a formula to determine maintenance, sometimes referred to as spousal support or alimony
- The more monied spouse may be required to pay the less monied spouse's legal fees for divorce proceedings
I, Maurice Verrillo, and my legal staff stay up to date on all developments in New York family law, and we are prepared to help you through this difficult time.
Child custody
Children are one of God's greatest gifts. But in a divorce or separation, you may face the possibility of losing your rights to see your children. Family Court examines several factors of the family's relationships when determining the best choice for custody:
- Age, sex, and mental and physical health of the child and parents
- The emotional relationships between the child and each parent, including any history of abuse or domestic violence
- The parent's lifestyle, including professional demands
- The child's typical routine
- Each parent's ability to provide food, shelter, clothing, quality education, and medical care to the child
- The child's preference, if the child is considered mature enough to choose
- The ability and willingness of the parent to encourage communication and contact between the child and the other parent
My staff and I hear your case, your concerns, and we advocate for you to keep your children. We understand that you will most likely have to retain a relationship with your former spouse, and we strive to craft a solution that reduces the emotional strain as much as possible but still safeguards your parental rights.
