New York Drug Treatment Courts Offer Relief to Accused Individuals With Substance Addictions
Despite decades of harsh drug laws in New York and elsewhere, substance addiction still causes widespread death and misery. Many authorities and experts have concluded that long prison sentences are not the best solution for some individuals convicted of drug crimes, and might even make things worse for people struggling with the abuse of controlled substances.
New York’s Drug Treatment Courts (DTCs) offer an alternative to traditional prosecution and incarceration for people whose criminal charges stem from a substance abuse disorder. This program, launched in Rochester 30 years ago, focuses on relieving the underlying problem through cooperation between defense attorneys, prosecutors, educators and treatment providers.
Defendants accused of a non-violent crime in which drug addiction is linked to the alleged offense may be eligible for a criminal DTC disposition. This is a voluntary program and is governed by a contract signed by the accused, defense counsel, the District Attorney’s office and the judge.
Once admitted, participants follow an individualized treatment plan that typically includes clinical services, regular court appearances, random drug testing and frequent check-ins with case managers. The court uses a system of graduated incentives and sanctions to reinforce progress and address setbacks. Many programs also connect participants with education, employment support and other stabilizing resources. Throughout the process, the judge receives input from the entire DTC team, allowing for informed, timely adjustments that keep the focus on safety and sustained recovery.
By successfully completing the terms listed in the DTC agreement, an individual accused of a felony or misdemeanor drug crime could have their charges dismissed or reduced. In situations where a defendant is not able to abide by the contract terms, a standard criminal prosecution will likely go forth.
